Note Dash School Access Terms of Use

These School Access Terms (“Terms”) govern subscriptions to Note Dash School Access, provided by Top Clef Publishing, DBA Notebusters (“we,” “us,” or “our”).

By purchasing School Access, you confirm that you are authorized to enter into this agreement on behalf of your school or organization (“Customer”) and agree to these Terms and our Note Dash Terms of Use (https://notebusters.net/note-dash-terms/). If these agreements conflict, these School Access Terms control for School Access subscriptions.

1. School Access License

School Access provides a limited, non-exclusive, non-transferable, revocable license to use Note Dash for educational purposes within the school or organization identified at purchase.

Access may be shared with authorized students, teachers, and staff within the licensed organization but may not be transferred, resold, or shared with other schools or organizations without our written permission.

We may establish reasonable usage restrictions and modify features, gameplay, access methods, or functionality at our discretion.

2. Subscription and Billing

Subscription prices, billing frequency, and applicable renewal terms are disclosed at checkout.

Recurring subscriptions automatically renew at the then-applicable subscription rate unless canceled before renewal. Customers may cancel through the provided subscription management portal or by contacting us. Cancellation takes effect at the end of the paid billing period.

Fees are non-refundable except as required by law or expressly agreed by us. We may change pricing for future subscription periods with advance notice.

Payments and subscription billing are processed by Stripe, a third-party payment provider. Payment information is subject to the provider’s applicable terms and privacy practices. We may use a different payment provider in the future.

3. Access and Acceptable Use

Customers are responsible for managing and safeguarding their School Access links and ensuring use is limited to authorized users.

We may monitor usage and gameplay records, enforce reasonable technical restrictions, and suspend or terminate access for suspected misuse, unauthorized sharing, security concerns, or violations of these Terms.

School Access is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free availability and, to the maximum extent permitted by law, are not responsible for outages, technical failures, interruptions, or resulting losses or disruptions, including those involving third-party services.

4. Students and Privacy

Customers are responsible for supervising student use, determining whether Note Dash is appropriate for their students, obtaining any necessary authorizations or permissions, and complying with laws applicable to their own activities. Top Clef Publishing remains responsible for its own obligations under applicable privacy and data protection laws.

School Access does not require student accounts, student names, email addresses, or rosters. Customers must not submit unnecessary student personal information.

We may collect network information, including IP addresses, and associate hashed network identifiers, browser or visitor identifiers, and gameplay performance information to monitor usage, prevent misuse, enforce School Access restrictions, maintain gameplay functionality, analyze usage and performance trends, and improve Note Dash.

School leaderboard submissions are optional and limited to three characters. Entries appear on the corresponding school’s leaderboard rather than the public Note Dash leaderboard. We may provide authorized school personnel with reporting or insights regarding School Access usage and gameplay performance, subject to applicable privacy laws. Reporting features, metrics, and availability may change over time and are not guaranteed.

School Access may be used by students under 13 only when such use complies with applicable law and any legally required notices, consents, or school authorizations have been provided. For such authorized School Access use, this provision overrides the under-13 restriction in the general Note Dash Terms of Use. Information is handled as described in the Note Dash Privacy & Cookie Notice. School authorization does not relieve Top Clef Publishing of its own legal obligations.

5. Changes and Discontinuation

We may update, modify, replace, or discontinue features or access methods at any time. We may discontinue School Access. If we permanently discontinue a paid subscription before its paid term ends for reasons other than Customer misuse or breach, we will refund the unused prepaid portion of that term, except as otherwise required or permitted by law.

We may update these Terms by posting revised terms. Material changes affecting an active paid subscription will be communicated when required by law. Continued use after the effective date constitutes acceptance to the extent permitted by law.

6. Liability and Additional Terms

School Access is provided “as is” and “as available,” without warranties to the maximum extent permitted by law.

To the maximum extent permitted by law, Top Clef Publishing’s total liability arising from School Access will not exceed the amount paid by Customer for School Access during the 12 months preceding the event giving rise to the claim. This School Access-specific limit controls over the general Note Dash Terms of Use liability cap for School Access claims. We are not liable for indirect, incidental, consequential, special, or punitive damages.

The Note Dash Terms of Use (https://notebusters.net/note-dash-terms/) are incorporated into these Terms, including their intellectual property, prohibited conduct, indemnification, termination, dispute resolution, and governing law provisions. Together, these School Access Terms and the incorporated Note Dash Terms of Use constitute the agreement for School Access. If they conflict, these School Access Terms control.

IMPORTANT: SECTION 17 OF THE NOTE DASH TERMS OF USE PROVIDES FOR BINDING INDIVIDUAL ARBITRATION AND A CLASS ACTION WAIVER, SUBJECT TO ITS EXCEPTIONS AND OPT-OUT RIGHTS. For School Access Customers, the 30-day period to opt out begins when Customer first accepts these School Access Terms. A School Access Customer may identify its organization and purchase date instead of the date it first used the App in its opt-out notice. Arbitration will be administered under the AAA rules applicable to the dispute, to the extent an arbitration agreement is legally enforceable against the Customer.
